Senator Leahy, I AM Saying There Is No Authority!

CNSNews.com asked Senator Patrick Leahy, Chairman of the US Senate Judiciary Committee, what part of the Constitution grants Congress the power to force every American to buy health insurance–as all of the health care overhaul bills currently do. Leahy, in typical progressive-weasel fashion, refused to answer.

CNSNews.com: “Where, in your opinion, does the Constitution give specific authority for Congress to give an individual mandate for health insurance?”

Sen. Leahy: “We have plenty of authority. Are you saying there is no authority?”

CNSNews.com: “I’m asking–”

Sen. Leahy: “Why would you say there is no authority? I mean, there’s no question there’s authority. Nobody questions that.”

Well Senator, you are WRONG.

You are WRONG, Senator, that nobody questions your authority to force Americans to buy goods or services that satisfy you but not us. In fact, just about EVERYBODY questions your authority to force us to buy something that we, the people, YOUR BOSSES, do not want to buy!

You are WRONG, Senator, that you have the authority to do it! The Constitution actually PROHIBITS you from forcing your purchase decisions upon we, the people, YOUR BOSSES!

CNSNews.com noted that HillaryCare in 1994 had a similar imposition.

The non-partisan Congressional Budget Office said in a 1994 report that for federal government to order Americans to buy health insurance would be “unprecedented,” adding that the government had “never required” Americans to purchase anything. “A mandate requiring all individuals to purchase health insurance would be an unprecedented form of federal action,” CBO found.

“The government has never required people to buy any good or service as a condition of lawful residence in the United States,” said the CBO report.

Senator Leahy, the CBO says you have no authority.

Nobody questions your authority?

Republican members of the Senate Finance Committee did question whether Congress had that authority when the health-care bill was being debated in their committee. Sen. Orrin Hatch (R.-Utah) tried to offer an amendment that would expedite judicial review of the bill were it enacted, but Senate Finance Chairman Max Baucus (D.-Mont.) ruled that Hatch’s amendment was out of order.

“If we have the power simply to order Americans to buy certain products, why did we need a Cash-for-Clunkers program or the upcoming program providing rebates for purchasing energy appliances?” Hatch asked on Oct. 1 when trying to offer his amendment in the committee. ”We could simply require Americans to buy certain cars, dishwashers or refrigerators.”

Senator Leahy, your fellow Senators, just last week, say you have no authority.

Most compellingly, Senator Leahy, the United States Constitution, which you swore an oath to protect from what you have become, a domestic enemy, SAYS YOU HAVE NO AUTHORITY!

Article I, Section 8 tells you what you may do. In the 10th Amendment, our founders told you essentially that they were serious when they told you all that you could do in Article I, Section 8. In short, the 10th Amendment simply says “By the way, we were serious.!” US Constitution, 10th Amendment:

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Read that, Senator Leahy! THERE IS NO AUTHORITY!

Your colleague in the House, Steny Hoyer, laughably tried to spew the DNC propaganda that the general welfare clause gives you authority to force such minute control over our lives. James Madison, “the Father of the Constitution,” blew that ridiculous stance right out of the water when he noted:

“If Congress can employ money indefinitely to the general welfare, and are the sole and supreme judges of the general welfare, they may take the care of religion into their own hands; they may appoint teachers in every State, county and parish and pay them out of their public treasury; they may take into their own hands the education of children, establishing in like manner schools throughout the Union; they may assume the provision of the poor; they may undertake the regulation of all roads other than post-roads; in short, every thing, from the highest object of state legislation down to the most minute object of police, would be thrown under the power of Congress…. Were the power of Congress to be established in the latitude contended for, it would subvert the very foundations, and transmute the very nature of the limited Government established by the people of America.

I, Senator Leahy, am saying you have no authority.

Further, Senator Leahy, I will note that you are bound by your oath of office to “support and defend the Constitution of the United States against all enemies, foreign and domestic.” You swore on a Bible that you would“bear true faith and allegiance to the same.” Your refusal now, and SO OFTEN in your past, to support the Constitution; your insistence now that the Constitution should be twisted and spun to suit YOUR ideological whimsy; your abject failure to bear true faith and allegiance to the United States Constitution places you in direct violation of what Article VI calls “the Supreme Law of the Land.”

Senator Leahy, not only do you not have the authority to subjugate American citizens to your chosen form of tyranny, you, as a violator of the Supreme Law of the Land are a criminal.

Senator Leahy, as someone who seeks ways to get around the United States Constitution, essentially trying to change the very structure of America, which is DEFINED by that Constitution, are a domestic enemy of the Constitution, the very enemy from whom you, yourself, are sworn to protect the Constitution.

Senator Leahy, you and those who share your opinion that the general welfare clause grants you authority to reign supreme over the citizens of the United States deserve thus to be arrested and prosecuted for your treason against the United States in doing more damage to this country and our Constitution than every foreign enemy throughout history COMBINED.

We, the people, are tired of your attempts to enslave us to a tyrannical central government!
